Your personal data (e.g. title, name, address, email address, telephone number, bank account, credit card number) are processed by us only in compliance with the provisions of German data protection law. The following provisions are intended to inform you of the nature, scope and purpose of recording, processing and utilization of personal data. This Data Protection Notice is valid for our websites only. If you go to other websites via links provided on our web pages, please inform yourself on the other websites as to how your data is handled there.

Art. 2 Automatic Data Recording

For technical reasons, the following data, inter alia, which is sent to us by your Internet browser, is recorded: – Browser type and version – Operating system used – Website from which you are visiting us (referrer URL) – Website you are visiting – Date and time of your access – Your Internet Protocol (IP) address.

This anonymous data is stored separately from any personal data with which you may provide us and therefore allows no identification of a certain person. It is evaluated for statistical purposes in order to assist us in optimizing our Internet presence and our offers. After evaluation, this data is deleted.

Art. 3 Master Data

Your personal data, insofar as such data is needed for the establishment, contentual detailing or amendment of the contractual relationship between us (master data), is used exclusively for purposes of contract handling and implementation. Thus, for example, your name and address must be passed on to the goods supplier to enable delivery of the goods. Your personal data will not be passed on to any third party not involved in the order implementation process except with your express consent or on the strength of statutory regulations.

We may, in individual cases and on the orders of the competent authorities, provide information on master data insofar as this is necessary for purposes of criminal prosecution or to enable the police authorities of the federal states to avert danger or for use in fulfilment of their statutory duties by the federal or state intelligence services, the German counter-intelligence service or the military counter-intelligence services or for the assertion of rights to intellectual property.

Art. 4 Utilization Data

Your personal data which is necessary to enable use of and billing for our offers (utilization data) is used for contract handling and implementation. Utilization data includes in particular the characteristics for your identification, information on the start and end and scope of the respective use, and information on the teleservices used by you. We may pass on utilization data for billing purposes (so-called billing data) to other suppliers or third parties provided such passing-on is necessary for the purpose of settling accounts with the user. After settlement in full of our claim to payment, the said utilization and billing data will be deleted. Instead of deletion, the data will be blocked if and insofar as preservation periods defined in the law, our statutes or contractual agreements stand in the way of deletion.

Revocation of Order

Art. 1 Revocation Notice, Right of Revocation

As a consumer, you have the right to revoke your contractual declaration within a period of two weeks, without giving reasons, either in writing (e.g. by letter or email) or – if you are already in receipt of the item concerned before the end of the said period – by returning the item. The period will begin on receipt of this revocation notice in written form, though not before receipt of the goods by the consignee (or in the case of recurring deliveries of goods of the same kind, not before receipt of the first part-delivery) and also not before fulfilment of our duties to inform pursuant to Section 246c (2) in conjunction with (1) Sections 1 and 2 EDBGB [Introductory Act to the German Civil Code] and also our duties pursuant to Section 312e (1) Sentence 1 BGB in conjunction with Section 246 (3) EGBGB. The deadline for exercising the right of revocation is met if the written revocation or the goods are dispatched in good time. The revocation must be addressed to:

Art. 2 Effects of Revocation

In the case of effective revocation, the performance received by each party must be returned to the other party, together with any benefit gained (e.g. interest). If you are unable to return all or part of the performance received or are able to return it only in impaired condition, you must compensate us for the loss of value. Where physical goods have been supplied, no compensation is payable if the impairment in the condition is merely the result of inspection of the item – e.g. such as would have been possible in a normal shop. You can, of course, also avoid the duty to pay compensation for impairment caused by using the goods for their intended purpose by not taking the goods into use as if they were your own property and avoiding doing anything that could diminish their value. Items that are able to be sent by parcel post must be returned to us for our risk. The costs of return delivery must be borne by you if the delivered goods are in conformity with those ordered and if the price of the goods being returned does not exceed a sum of €40.00 or if, in the case of higher-priced articles, you had not yet effected counter-performance or a contractually agreed part-payment at the time of revocation. In all other cases, return of the goods is cost-free for you. Items which cannot be sent by parcel post will be collected from your address. Payment refund obligations must be met within 30 days. This period shall begin for you on dispatch of the declaration of revocation or dispatch of the item, and for us on receipt of the declaration or item.

Art. 3 Exceptions

No right of revocation exists in the case of mail-order contracts

1. for the supply of goods which are made to customer specification or are clearly tailored to meet personal needs,

2. for the supply of audio or video recordings or software if the data carrier has been unsealed by the consumer, and

3. for the supply of newspapers, magazines or periodicals.

General Terms and Conditions of Business

Art. 1 Scope of Application, Customer Information

The following General Terms and Conditions of Business (the “Terms and Conditions”) shall govern the contractual relationship between the company Kings Road Merch GmbH and consumers who purchase goods through the “Kings Road Merch” Internet shop. Terms and conditions of an entrepreneur that conflict with or deviate from these Terms and Conditions will not be recognized. These Terms and Conditions also include customer information pursuant to the “BGB-Infoverordnung” [German Civil Code – Information Ordinance]. The contractual language is German.

Art. 2 Conclusion of Contract

(1) The offers on the Internet constitute a non-binding invitation to you to purchase goods.

(2) By entering your data and clicking on the “Order” button, you make a binding offer to conclude a purchase contract.

(3) We have the right to accept your offer within 5 days by sending an order confirmation by email. If no such confirmation is sent within the period stated in sentence 1, your offer is to be deemed rejected, so that you will no longer be bound by your offer.

Art. 3 Customer Information: Storing of Offer Text/ Correction Possibilities

(1) The text of the contract with particulars of the article is not stored.

(2) You can correct your entries at any time before sending the order. You will be informed of your correction possibilities during the order process.

Art. 4 Terms of Payment

We generally accept payment in advance, payment by PayPal and payment by credit card.

(1) Payment in advance

For payment by transfer, Kings Road Merch will inform you of the bank account details in the email confirming the order and will dispatch the goods on receipt of payment. Payment must have been received on the Kings Road Merch account within 3 weeks from receipt of the order confirmation.

2) PayPal

In the case of payment by PayPal, the PayPal account data will be sent to you in the course of the ordering process or in the email confirming the order. Payment will be made immediately from your PayPal account to our PayPal account with the address paypal@kingsroadmerch.eu

(3) Payment by credit card

The goods will be dispatched as soon as the amount has been credited to our account. Payment must be made to the Kings Road Merch account within 3 weeks from receipt of the order confirmation.

Art. 5 Delivery

(1) If Kings Road Merch accepts your order, the goods will be delivered as soon as possible. In the case of orders with payment in advance, the goods will only be dispatched on receipt of the full amount by Kings Road Merch. We will not reserve any ordered goods prior to the receipt of payment.

(2) If we are unable to deliver ordered goods through no fault of our own, e.g. because one of our suppliers is in breach of its contractual obligations, we shall have the right to cancel the contract with you. In this case, we will inform you immediately that the ordered goods cannot be supplied. Any performance already made by you will be returned immediately.

(3) Delivery will be made to the address stated by you. We reserve the right to make part-deliveries, if need be.

(4) Before accepting the delivery from the parcel delivery service, please ensure that the package or packages has/have not been opened, damaged or tampered with in any way. Should they have been, you should make a written record to this effect in the handover record presented by the parcel delivery service driver.

Art. 6 Articles, Prices, Delivery Costs

(1) The articles offered by us are originally licensed goods. Depending on the computer screen used by you, colours and colour shades of the articles shown on the screen may differ from those of the original item.

(2) Trade marks and brand names shown are the property of their respective owners.

(3) All prices include value added tax at the statutory rate but are subject to the addition of delivery costs. The article and delivery costs valid at the time of ordering apply. You will be informed of the delivery costs during the ordering process and here (Terms and Conditions of Delivery).

Art. 7 Return Costs in Case of Revocation of Order by Consumer

If you, as a consumer, make use of your right of revocation, the costs of return delivery must be borne by you if the delivered goods are in conformity with those ordered and the price of the goods being returned does not exceed a sum of €40.00 or if, in the case of higher-priced articles, you had not yet effected counter-performance or a contractually agreed part-payment at the time of revocation. You need only bear the regular costs of return delivery. Any additional costs arising e.g. through a change in our place of business or through the use of more expensive transport services on our request will be borne by us.

Art. 8 Reservation of Title

The item of sale shall remain our property until payment of the purchase price in full.

Art. 9 Warranty Claims

In the case of purchase of new goods, the warranty claims as set forth in the statutory regulations shall apply. Minor differences in colour between illustrations and the delivered goods are due to technical reasons. In the case of all-over prints or prints on seams, zip fasteners and pockets, small unprinted areas may occur as a result of the complex printing process and are unavoidable. Circumstances of the aforesaid kind shall not constitute a fault or non-compliance; defects which are due to failure to comply with care instructions (see label) or to normal wear and tear shall likewise not constitute a fault or non-compliance.

Art. 10 Limitation of Liability

(1) We exclude liability for breaches of duty caused by minor negligence insofar as such breaches do not relate to duties which are material to the contract or involve damage or injury to life, limb or health or claims under the Product Liability Act (“Produkthaftungsgesetz”). This shall also apply to breaches of duty on the part of our vicarious agents and our legal representatives. Material contractual duties shall include in particular the duty to furnish you with the item concerned and to procure title thereto on your behalf. We further have a duty to furnish you with the item free of physical and legal defects.

(2) Given the current state of the technical art, data communication via the Internet cannot be guaranteed as being fault-free or available all the time. We shall therefore have no liability for our Internet shop being available at all times.

Art. 11 Applicable Law

All disputes arising from or on the basis of these Terms and Conditions shall be governed by German law; the UN Convention on Contracts for the International Sale of Goods shall not apply.

Art. 12 Severance Clause

Should any of the provisions of these General Terms and Conditions be or become invalid or unenforceable, this shall have no effect on the other provisions hereof, unless the voidance of individual clauses would be so unreasonably detrimental to either of the parties that that party could no longer be reasonably expected to be bound by the contract.

Pre-orders: How Do They Work?

The latin prefix “PRE” means “before” and “order” is the action that you just did. You ORDERED BEFORE the release date. That means, you purchased or are about to purchase a record or sweet, exclusive bundle that has a street date in the future. This means you will not have your order shipped until the week leading up to the release date.

This date varies by product and will be on the item description page, and on your order confirmation email. We will not ship until the week leading up to the release date so please be aware of what this date will be. Postage options may prevent you from getting your order exactly on release date, but we will ship ON or BEFORE the release date.

We ship all products with FedEx, DHL as a secured package or Deutsche Post as a registered mail to avoid any shipping risks .

Important: All our orders will be shipped from our warehouse based in Germany.

We ship all our DHL packages via GoGreen, this means that DHL donates a small fee per package and invests that money in Climat control projects like rainforest reforestation and alternative energy. The goal is to create more „Co2“ friendly shipping methods.

How do I use discount codes & gift cards?

If you want to enter a discount code and/or a gift card code, please click on the items link in your shopping cart. After clicking, you will see a section on that page where you will be able to enter your discount code and/or gift card code.

How do I get you to stop emailing me your newsletter?

All you have to do is to click on the link at the bottom of one of the newsletters you receive from us and our system will remove you from all future emails.

Is ordering from you on the Internet safe and secure?

Our shop system is SSL certificated, which means it’s perfectly safe to order from our store.

What should I do if my goods were damaged in transit?

We take a great deal of care when packing orders to make sure that the items you’ve ordered arrive undamaged, however, occasionally goods do get damaged in transit. If you believe your goods have arrived damaged please contact our customer services team and they’ll help sort you out.

What should I do if you've sent me the wrong goods?

If you find that we’ve sent you the wrong goods you should fill out the returns form on the back of your delivery note and return the forms and goods to us so that we can exchange it for the correct item for you. If you’ve lost your original delivery note you can print off a downloadable returns form. Please be aware, however, that we are unable to refund items that have clearly been worn, laundered or have been subjected to abnormal usage.

What should I do if something from my order is missing?

There can be a couple of reasons why you may receive your order with some items missing. The usual reason is that one of the items you ordered was unavailable and so we have refunded you for that item. If you discover that your goods are missing please contact our customer services team and explain the situation.

What do I do if the goods I ordered haven't arrived?

Please check if you got a note from the mailman. There might be a chance you were not home when your items were delivered. In some cases they will leave your package at your neighbor’s house.

A second option would be to check your local post office. They might be holding it for you.

I'm not at home during the day. How can I get the items I have ordered?

We offer you the option of giving a delivery address other than your home address so you could arrange for your goods to be sent to your workplace or a neighbor who you know is in during the daytime.

How will I know when my order ships?

Once your order has been shipped from our warehouse an automated email is sent to your email address.

How long will it take for my order to arrive?

Once your payment has been processed, most orders are shipped within 1-2 working days. Once your order has been shipped, it takes 1-2 days to be delivered within Germany, about 1 week to be delivered to other European countries and approximate 3 weeks for all countries outside of Europe.

We ship to Europe, UK, North America and several other countries as well. If your country appears in the country dropdown list then we are able to ship to your address.

Where do you ship from?

All orders from Kings Road Merch EU will be shipped from our warehouse based in Germany.

Why didn't I receive an email confirming my order?

Some email accounts like Hotmail, Yahoo and AOL cause email messages from unknown senders to go to the spam folder. Please check your spam folder to see if it ended up there. If the email didn’t end up in your spam folder, there might be a chance you accidently entered your email address wrongly when you registered with us. Please get in touch with our customer service at support@kingsroadmerch.eu or give us a call on +49(0)231-496694-0 if you would like to have this email send to you again.

Can I cancel my order after it has been submitted?

If you have completed your checkout and wish to cancel your order, please email us at Can I change my order after I have placed it?

If you have placed an order and haven’t completed checkout, you can delete the item out of your shopping cart by simply clicking on the box next to the item. Your shopping cart will automatically be updated.

Can I order items that are ‘Out of Stock’?

Unfortunately you can’t buy products that are out of stock. We do provide the service to notify you when the item you are interested in is back in stock. Just click on the link next to the product ‘’notify me when item is back in stock’’ and leave your email address behind. We will immediately send you a notification when the item is back in stock.

What payment methods do you accept?
